OVR TERMS AND CONDITIONS OF SERVICE (Japan Trips)

Of OvR ride, LLC (“OvRride” or “OvR”)

By purchasing any OvRride Japan package you agree to be bound: The tour package arranged by OvRride is being provided to you expressly under the term and conditions set forth below (the “agreement”). By purchasing the package and by the act of making payments for the tour package, you hereby acknowledge and represent that you have read these Terms and Conditions, and further you agree to be bound to all of these terms and conditions stated herein whether or not you sign any agreement.

OvRride Japan Package

By purchasing any OvRride Japan package you acknowledge that OvRride is not providing any service beyond the coordination of services offered by third party providers of accommodations, travel, food and beverage and various other activities as described in the package description. As such, you further acknowledge that OvRride is not the provider of any of the services scheduled in the tour package. The third party service providers are as follows:

IACE: Air transportation to/from The USA and Hokkaido, Japan

Rusutsu Resort (Kamori Kanko): Hotel accommodation, lift tickets, and ground transportation in Rusutsu

Koropokkuru: Hotel accommodation in Niseko

Daisetsuzan Shirakabaso: Hotel accommodation in Asahidake, Dansetsuzan

By purchasing any OvRride Japan package you acknowledge that you have received and read the terms and conditions of the above third parties and agree to be bound those terms and conditions.

OvRride does not own or operate the entities that provide goods and services during the Japan tour. This includes, but, is not limited to, lodging facilities, airline, guide services (from third party organizations), train, or other transport companies. All such entities are independent organizations. OvRride is not liable for any negligent or willful act or failure to act of any such person or entity, or of any third party. In addition and without limitation, OvRride is not responsible for any injury, loss, death, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services, whether resulting from, but not limited to, acts of God, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, third party (including Client) negligence, recklessness, or intentional misconduct, strikes or other labor activities, criminal or terrorist activities of any kind, mechanical or other failure of airplanes or other means of transportation, or for any failure of any transportation mechanism to arrive or depart on time. In exchange for the services provided by OvRride, you agree to release OvRride from all claims for loss, injury, damages, whether based in contract or tort, arising out of or relating to any of the services provided by any third parties.

If any provision of this agreement is held to be invalid or unenforceable, all other provisions hereof shall nevertheless continue in full force and effect. The parties acknowledge that this agreement shall not be subject to change or modification except by the execution of another instrument in writing, subscribed to by the parties hereto. The parties agree that this agreement shall be construed and applied according to the laws of the State of New York, without regard to its principles of conflicts of law. The foregoing contains the entire agreement between the parties, and there are no other understandings or agreements between them.

Privacy Policy

OvRride respects your privacy and will not use your personal information for any other use than assisting you with ski and snowboard vacations to Japan. We will not share your personal information with any other people or companies.

Deposit & Payment Policy

A $999.95 deposit is due upon booking for any of our Japan excursions. Up until 90 days before the trip, deposits are refundable, within 90 days, all funds paid until that point are non-refundable. A minimum of the deposit and an additional 50% of the balance (after deposit is made ) is due and is non-refundable at the 90 days before the trip date. Final payment is due 60 days prior to trip or if time of booking is less then 60 days of arrival for all resorts. Credit card on file will be automatically charged for the balance within 60 days prior of the trip. For bookings made within 60 days of arrival, full payment is due upon booking. You will be sent a written confirmation of your booking by email.

Full payment for any OvRride Japan Package and any additional fees (for the extensions, private rooms, participation from other cities, etc.) shall be paid in full no later than December 1st of the year prior to travel to avoid possible financial penalties.

Although we do not anticipate any changes in price, you agree that prices for the tour package are subject to change due to any increases in price charged by the third party provider up until 90 days before the trip. OvRride will notify all guests of any change in price promptly if such an unlikely change should occur.

Cancellation Policy

Cancellations must be made in writing in the form of an email to info@ovrride.com. This cancellation email must originate from the email address used to book the reservation. No reservation is considered canceled until acknowledged by return email.

Cancellations made by you;

A) 91 days or earlier before trip are refunded in full
B) 90-60 days, all deposited funds up to that time are forfeited.
C) Within 59 days before trip will result in full forfeiture of the total $ amount of the booking.
No Refund can be processed regardless of death, sickness or medical injury. 

*We are compassionate and understanding people at OvRride and can evaluate available options on a per situation basis when there is death, sickness or medical injuries involved with participants or their friends or family members. However, to possibly do so on a per situation basis we will require documentation emailed immediately otherwise there is no possibility. It is important to note in these situations we will try our best but there is no guarantee and is dependent on the individual resort or hotel’s decision on a per situation basis.*

If this possibility of cancellation concerns you, we highly suggest that you purchase trip cancellation insurance to avoid penalties due to a change in plans. Cancellations made by Third Party Providers;

(a) Cancellation by Third Party Providers – In the event that the tour, or any part thereof, is canceled by any third party provider of the tour due to war or natural disaster, OvRride shall on your behalf work with the third party provider for the return of your payment attributable to that part of the tour. You acknowledge that each third party provider maintains its own cancellation and return policy and that you will only look to the third party provider for any refund of any payment should this unlikely scenario occur.

Single Supplements & Upgrades

Depending on the trip, upgrades & single person in a unit or room lodging supplements may be available. Please check with us for further details and pricing.

Changes

A change of trip or dates (re-booking), is considered a cancellation, therefore cancellation fees apply. We do not sell TRIP INSURANCE, however we recommend buying some if you think there will be potential changes in your vacation or with certain members of your group.

Refunds

No refunds will be issued on whole or partially unused portions of packages.

Preparing For Your Trip

Our guests are responsible for the provision of all necessary valid documents such as passports, visas, health requirements and drivers licenses for the country they are visiting. Clients are responsible for contacting the appropriate consulate, embassy, or searching online themselves, OvRride is NOT responsible for any kind of credit or refunds if a guest is denied departure or entry from/to a country or has not arranged the appropriate documents such as valid passports, visas, etc. We are also not responsible if a guest is denied entry into the destination country they are travelling to before or after departing country of origin or connecting or transit country.

Taxes

All taxes are included in the prices quoted OvRride.

Currency

All rates are quoted in USD currency unless otherwise noted.

Insurance

Your lift ticket insurance in Japan does NOT cover out of bounds skiing and snowboarding rescue or post out of bounds accident care or treatment. If you are an advanced/expert skier or snowboarder and this concerns you, we recommend purchasing or having health/travel insurance that covers out of bounds riding.

Health / Dietary Needs

By sending a deposit, you certify that you do not have any physical condition or disability that would create a hazard for you or other travelers. Please inform us prior to your departure if you have any special dietary or medical needs.

Medication and Medical Needs

You are responsible for bringing and/or purchasing and administering any needed medical supplies. You should bring supplies for a minimum of sixteen (16) days. OvRride is not responsible for the purchase or administration of any medications for any persons.

Late Arrivals & Departures

OvRride cannot accept responsibility for travelers inconvenienced by late, diverted, delayed, canceled, or rescheduled travel arrangements. This also applies to missed flight connections or transfers and if airports, border crossings, train stations and trains, buses and bus stations are closed. If clients are not able to depart from country of origin/connecting country or arrive in destination country via air, land, or water for whatever reason, weather, natural disasters, plane accident, fuel problems, wind, ashes, volcanic activity, floods, political problems, disease, any reason at all, OvRride is NOT responsible for any credits or refunds for any portions of the trip you have booked with us, although we always do our best to accommodate our guests in the event these dilemmas occur.

If, due to weather, flight schedule changes, cancellations or other uncontrollable factors, you are required to spend any additional night(s) en-route to, or from, your gateway city, you will be responsible for your own hotel, transfers, meals, and other costs.

Personal Belongings, Baggage & Documents

All personal belongings, baggage, and documents remain at all times and in all circumstance the owner’s responsibility and is at no time the responsibility of OvRride. If baggage or personal items are lost or stolen on flights, ground transfers, inside accommodation or on buses.

Dispute Resolution

The parties agree that all disputes, claims, and questions regarding the rights and obligations of OvRride and our guests, including those rights and obligations arising under this agreement, shall be arbitrated in the State of New York. In case of dispute, either party may make a demand for arbitration by filing such demand in writing with the other party. The demand will be made within 90 days after the dispute first arises. No one will act as an arbitrator who is in any way financially interested in the work or the business affairs of either party. The arbitrator will act in compliance with the rules of the American Arbitration Association, existent at the time of the arbitration. The decision of the arbitrator shall be final and binding. The arbitrator will fix his or her own compensation, unless otherwise agreed on or otherwise determined by the rules of the American Arbitration Association, and, except as otherwise provided, will assess the costs and charges of the arbitration on either or both parties, equally. The arbitrator is authorized to award to the party whose contention is upheld such sums as he or she deems proper for the time, expense, and trouble incident to the appeal, including the costs and charges of the arbitration. No tour will be interrupted or delayed during any arbitration proceeding except on written agreement signed by both parties.
